Brain Davis listens to opening statements of the prosecution in his 1st Degree murder case.

(Sidney) -- The murder trial of Brian Heath Davis will be in recess today following yesterday's second day of testimony.

The trial is scheduled to resume tomorrow in Fremont County District Court. The prosecution offered additional testimony yesterday in their attempt to show the death of Holly Durbin was indeed a murder. The prosecution is expected to complete testimony from their witness bank when court resumes at 9 o'clock tomorrow morning. Then, the public defenders representing Davis is expected to begin presentation of their claims that the July 2009 death of Holly Durben was not a homicide, but a suicide.

The trial is a bench trial with Judge Timothy O'Grady presiding.
